IRS Issues New Rules for Marital Status

In light of the recent Supreme Court ruling regarding same-sex marriage, the IRS has issued proposed rules defining marriage for federal income tax purposes.

The terms spouse, husband and wife will now mean an individual lawfully married to one another individual.  Further, the term husband and wife will refer to two individuals lawfully married to each other.
A marriage will be recognized for federal tax purposes so long as it is recognized by any state, possession or territory of the US.  A foreign marriage will also be recognized so long as it is recognized by at least one state, possession or territory of the US.

Note that Civil Unions, registered domestic partnerships or other similar relationships will NOT be considered marriages for federal income tax purposes.

Under Colorado law, your income tax filing status will always be the same as your status on your federal income tax return.
